TERMS OF PURCHASE AND SALE

1. Who we are and what we do
reCRQL AB ("we"), Sankt Paulsgatan 22A, 118 48 Stockholm, Sweden, runs a marketplace where private individuals and businesses ("sellers") sell second-hand goods to buyers. The shops you buy from run on our platform. We take your payment, hold the money until the purchase is complete, pay the seller and handle cases when something goes wrong.
The seller is your counterparty for the item. We are not the seller unless the listing says so.
2. When these terms apply
These terms apply when you buy or sell through the platform. You accept them at checkout when you buy, and when you create a seller account. We keep a record of which version you accepted and when.
3. Purchase and payment
The price of the item, shipping and any service fee are shown before you pay. The purchase is complete when the payment is confirmed. You get a confirmation by email.
4. Delivery
The seller ships the item with the delivery method you chose. You get tracking details by email. If the parcel never arrives, we help you as described in section 7.
5. Right of withdrawal
If you buy from a business, you have 14 days to withdraw from the purchase from the day you received the item, under the Swedish Distance Contracts Act. Tell us through the link in your order confirmation or in a message of your own. Unless agreed otherwise, you pay for the return shipping. Purchases from private individuals have no right of withdrawal.
6. Faulty items
If the item is faulty, damaged, not as described, or never arrived, report it through the link in your order confirmation as soon as you notice. Photos help. The seller's payment is held while we look into it.
If you buy from a private individual, report the fault within 5 days of receiving the item. After that we pay the seller, and no case about the purchase can be opened on the platform. If you buy from a business, the payment is held for 14 days, and you also have your rights under the Swedish Consumer Sales Act.
7. Cases: we make the decision
Once a case is opened, we investigate it and decide how it is resolved. By buying or selling on the platform, both buyer and seller accept our decision as final between them on the platform.
- We can ask both buyer and seller for evidence, such as photos, descriptions and tracking details, and decide on what we receive.
- We can reject the case, refund all or part of the price, have all or part of the item sent back, and decide who pays for the return shipping.
- We decide whether the seller or we bear the cost. If the seller does, it is deducted from the seller's payout for the sale.
- We hold the money until the case is decided and then carry out the decision: a refund to the buyer and the remainder paid out to the seller.
- If the item is to be sent back, the refund is made once the seller confirms it has arrived.
None of this limits your statutory rights. As a consumer you can always turn to the Swedish National Board for Consumer Disputes (arn.se), the EU online dispute resolution platform, or a court.
8. If you sell
You are responsible for the item matching its listing and being shipped on time and well packed. You accept that we hold the payment during the withdrawal and complaint period and while a case is open, and that our decision in a case is carried out against your payout as described in section 7. Answer our questions in a case; otherwise we decide on the evidence we have.
9. Personal data
We process the data needed to complete the purchase, deliver the item, pay out and handle cases. Data is shared with the seller, the carrier and the payment provider as far as that requires. Read more in our privacy policy.
10. Changes and contact
